Question: Can an illegal immigrant get custody of a child after he has been deported?

Call the police and ICE if he returns, if he takes off with the baby back to his country it will be hard for her to fight it and get the baby back.

Probably not. If he was deported, then he probably CAN'T come back, even if he wants to. If I were your sister, I'd take his name off of the birth certificate. She can still let him see the child, but not be concerned about custody issues.

Yes! He is the babys father. If he chooses to, he can also have a birth certificate done under his nationality making the baby a dual citizen. So yes he can, and it would all be legal either way.

It would be great if people made better decisions when getting involved with illegals.

1) Yes. He can go to family court and sue for custody. The driving principle in family court is "what's best for the child".
2) Why was he deported? This can have an effect on the courts decision.
3) What country is he from? Certain countries the courts will avoid allowing the child to travel to as they do NOT abide by international parental abduction laws.
4) What country is he from? Some countries do not allow dual citizenship. Some countries may or may not give him a passport for the child.
5) You can file to make sure that the child doesn't get a US passport but...
